1.) General

  1. By commissioning me in any kind of way, you are agreeing to the terms of service below.

  2. I reserve the right to decline any commission.

  3. I reserve the right to cancel and refund any commission.

  4. You must be 18 or with guardian consent to order art from me.

  5. I communicate regarding commissions on Discord only.

  6. You may message me anytime about your art commissioned.

  7. I do work at another job M/W/TH/F from 9:30am-5:30pm EST. Keep this in mind.

  8. I am ok working with NSFW/nude refs. Or anything else that depicts sexual materials.

  9. NONE OF MY ART MAY BE USED FOR AI, YOU MAY NOT TRAIN IT FOR AI, YOU MAY NOT USE MY STYLE FOR AI, YOU CANNOT DO ANY AI WITH MY ART.

2.) Payment & Refunds

  1. I take either PayPal or Ko-Fi as payment. Other payment measures can be discussed.

  2. I take payment upfront after accepting your commission request.

  3. Payment plants for pricing exceeding 400 can be discussed.

  4. I can refund at any point in the process.

  5. You may request a refund for Custom designs only At the point of being refunded, I then own the design fully and can resale or keep as I see fit.

  6. The only clause to this is CBCs/Kinsonas (Character based characters) cannot be refunded.

  7. I may take refund requests for illustrations, it is case by case. Most likely will be only for a partial refund

  8. I only take USD. Keep that in mind when commissioning me.

  9. Don't send thru friends and family!

3.) Permissions and Usage

  1. I, the artist, reserve the rights to my art. This doesn't include characters depicted if not owned by me.

  2. Illustrations cannot be used for commercial use, only personal

  3. I do take commercial use illustrations, but this must be discussed upfront, and will have an up-charge for such commission.

  4. When you are posting my art online, please link back or credit me somehow. If using ToyHouse, use onsite credit to credit me. Otherwise, linking to this card or my ko-fi is fine!

  5. If you are NOT the commissioner of the art, you may NOT reupload for personal use. Such as using it as a icon/pfp, banners, etc. You need the commissioner's explcit permission.

  6. Any of my personal works may be used as personal wallpapers for phones/computers/etc. May not be for public profiles such as pfps/icons/banners

  7. I reserve the right to post any commissions I get online. I don't provide private commissions.

If you are NOT the commissioner of the art, you may NOT edit the work. But, if you are the commissioner of the work you may only do the following...

  1. Add transparent images ontop such as 'stickers', you must still credit the artist of said 'stickers'

  2. Add a filter / color overlay

  3. Crop/resize the image

If you commissioned or not, you may NOT do the following.

  1. Removing my signature (“Carlarzall” + the year on the picture)

  2. Draw on top the image (trace or otherwise)

You MAY do the following WITH PERMISSION OR CREDIT

  1. You may reference my art to inspire yourself / grow your style.I strongly prefer you not to 1:1 copy my style, but to use my work as building blocks.

  2. You may reference posing I've done. I'd love to see works you've done inspired off mine, but showing me isn't required.

  3. You may inspire yourself off my designs, colors, markings, etc. Just once again don't 1:1 my designs/art/etc - Meaning don't completely copy my work, use it as building blocks.

The following rules are only for Fan art for existing medias

  1. You may use my fan-art for existing medias (examples; DC/Marvel, Sonic the Hedgehog, Transformers, etc) as icons/pfps/banners with credit to me. - Linking to my carrd is suffice.

  2. My fan designs are ok to be inspired off of, unless stated otherwise. Don't use the fan designs for OCs however, only other fan designs.

  3. Using my fan art as personal non-online ways such as wallpapers on phones, printing out for your room is ok. I would love to be tipped however!

4.)Customer satisfaction

I will do everything I can to make my customers happy.
However after a commission is finished, only small changes are allowed to be made.
(Such as coloring mistakes, slight small details, etc...)

Any great changes will come with an extra charge.
(Such as an outfit change, outfit addition or subtraction, background change, or anything that makes me have to redraw it completely.)

  1. If your reference was unclear to start with, then you are not allowed to do minor changes without a fee. I will alert you before taking on a commission if your reference is unclear

  2. Make sure to be clear in your order about what you aim for.

  3. I will not edit artwork dramatically even if it’s still a WIP. Example: You want to change from a headshot to a full body. Upgrading to shading is allowed, but not the full pose/type of artwork.

  4. I work best with reference photos for complex posing, such as stock photos or even taking a photo of yourself for a certain out-of-the-ordinary pose.

  • Non-con / rape / pedo art

  • NSFW or mature for minors

  • Other media/artists styles (MLP, comic book art styles, certain artist's styles, etc. I have my own style.)

Keep in mind...

  • I can always deny a commissions for reason or without reason.

  • Some topics may be listed as 'what I will draw', however I may still decline.

  • As also some topic may be a 'won't draw', but at rare moments I may accept- example such as a faux political themed poster, slurs in artwork that I and the commissioner can reclaim, etc. It is very rare but don't be afraid to message me and ask, I won't shame.

✦Character Design & Adopts Terms Of Service✦

1.) General Rules

  1. Once you've sent the full payment agreed upon you're pretty much free to do as you wish with your new OC!

  2. After purchasing the adopt from me, I reserve the rights to the art only, such as being able to repost the OC as artwork, but you reserve the rights of the OC. Meaning you own the design, I can still use the OC shown as part of my portfolio, nothing more.

  3. All of my designs are genderless by default. No matter if theirs topscars there or breasts, or it looks masc, fem, or andro, those are only design elements not matter of gender! You're free to make the character any gender, any body type, species, change the markings, colors, etc.

  4. Feel free to make merch such as stickers/plush/clothing of the character, fursuits etc. You may not use MY art as the merch however. Only the design itself.

  5. If you're wanting to implement the design into a large scale project such as comic, book, video game, etc. You must let me know as I do want to be alerted; depending on the size of the project I may request finical compensation at any point.

  6. Regardless if you own the design or not, you MAY NOT USE AI IMAGERY IN ANY WAY WITH REGARDS TO MY DESIGNS That is including, but not limited to; training AI off the design, making images intended to be the character with the AI, etc. Doing so will result in permanent blacklisting of all future ownership of my designs.

  7. I only require the inital crediting on TH for the design. Meaning you don't need to credit me each time you draw the OC, but it is ok if you'd like to do so.

2.) Ownership and transfering ownership

  1. You may trade, sell, gift, etc the design to whoever as long as they aren't blacklisted.

  2. You may NOT sell a design and only the design alone for more than it's worth. (If added on personal or commissioned art, use the appropriate pricing.)

  3. I don't settle disputes for ownership unless it is 100% my fault (such as sending the design to the wrong user.) If you've been scammed, I cannot help.

  4. Co-ownership is allowed at your own risk

  5. I do not revoke desgins based off of tos breakage, I only blacklist. I only revoke for nonpayment.

✦Base/Lineart TOS✦

1.) General Rules

  1. Please credit me somehow regardless If they are free or pay-to-use!

2.)Allowed usage

  1. Make adopts in any currency

  2. Make designs for personal use

  3. Sell adopts for however much you want (unless the base rules say otherwise!)

  4. Frankendoll/add other base elements as long as the other artist is ok with it

3.)Disallowed usage

  1. Resell or share a blank base - please link to the upload I post

  2. Share p2u bases freely / to others

  3. Claim the original base as your own

✦Blacklist✦

0.)Blacklist meaning

If you are blacklisted you may not...

  1. Own any of my designs

  2. Try to commission me for art or designs

  3. Attempt to gain any of my designs or commission me from a third party

Sometimes mistakes happen such as you being a blocked user and not knowing that. I am forgiving and don't particularly honestly police my blacklist, as long as you aren't any of the following publicly blacklisted users. Public blacklisting is a last resort and they know they are blacklisted for a serious reason.

1.) Public blacklist

  1. Do not go after anyone listed below other than to be aware and/or to block them.

  2. I do not condone any harassment, abuse, or any kind of contact to them at all.

  3. These users may not own any future designs by me, may not be traded designs by me, may not use my bases/linearts, templates, resources, etc.

2.) General blacklist

I do not permit anyone who is any of the following to own my designs, nor do business with me.

  1. Racists, homophobes, transphobes, ableists, xenophobes, zoophiles, MAPs

  2. Anti-xenopronouns/xenogender, anti-therians, anti-furrie

  3. If you're against good faith identities, just because it doesn't 'make sense' doesn't mean it is valid.

  4. People who are weird to systems, endo-systems, people who equate introjects to their sources.

3.) Blocked users

If you've blocked me or I've blocked you, or both ways around, you are blacklisted.

  1. If you've unblocked me and I haven't blocked you, the blacklist is lifted. Vise versa.

  2. I'm always open to reconcile bad relationships, feel free to reach out, I'll let you know if I am ok with it or not.

What brushes / programs do you use?

  • I go back and forth from using an iPad Pro and my crappy 'lil laptop. For my iPad I use Procreate, for my laptop I use Clip Studio Paint.

  • For my brushes that's a bit harder of a question since most of them I've bought / downloaded. If there is a certain one you really want, message me.

Can I use your art as an icon/pfp/header/banner?

  • As stated in my tos it depends on what kind. If its personal piece or fan art, you may go ahead and use it with credit. If it is a commission for antother user, you may not use it.

Can I get your work tattooed? Do you take tattoo commissions?

  • Depends on the piecce, if its a commission its a flat no For anything else, inquire!

Why should I buy a premade design? Or a custom design? What do I even do with it?

  • When you get a desgin from me its now yours to own! Think of it like an OC, but made by me. You own it, I made it.

  • Its great for people who either like my designs or just don't want to design for themselves.

  • You can use the design as a fursona, as a mascot, for a story, etc. Just keep my tos in mind!

Can you draw this species/animal/creature?

  • I grew up drawing Transformers, so I love to think I can draw anything.

  • If theirs a serious concern of mine that something is too hard to draw, I will let you know. But most likely the answer is I can draw it!

Can you make me a kinsona/CBC/etc?

  • Most likely will be a Yes, but please read my tos regarding CBCs.

  • I work best with medias I know, check out my interests to see what I'm knowledgeable about.

  • If its a character based on something that is not an existing media, such as someone else's OC, it is a No. - Unless with proper permission or its your own.

Can you draw/design something similar to [artist name here]

  • No. I don't take inspiration for commissions from other pieces of art. CBCs are a bit different as I'm referencing an existing media character, and not the art it self.

  • If its a famous artist like a classical painter, or a genre of art, I may consider doing so.
